Why AI Tools Create GDPR Risk
Most organisations using AI tools are creating GDPR exposure without realising it — every time they paste a document.
When you paste text into ChatGPT, Claude, Gemini, or any cloud-based AI assistant, that text is transmitted to and processed on the AI provider's servers. Under GDPR, this means:
- The AI provider becomes a data processor under GDPR Article 28
- You, as the organisation pasting the data, remain the data controller — responsible for the lawful basis and all obligations
- Any transfer to US-based servers triggers Chapter V international transfer rules
- If the document contains special category data (health, ethnicity, religion, etc.), Article 9's stricter rules apply
The vast majority of business documents used with AI tools contain at least some personal data: names in email threads, contact details in CVs, financial identifiers in invoices, or health references in HR records. The risk is not theoretical — it is constant and routine.
Key GDPR Articles That Apply to AI Tool Use
You must have a valid lawful basis (consent, contract, legitimate interests, etc.) for every use of personal data — including when that processing involves an AI tool.
Health data, biometric data, genetic data, racial/ethnic origin, religious beliefs, and political opinions require a higher level of justification. Most general lawful bases do not apply to special category data — explicit consent or a specific exemption is required.
Data subjects have the right to know how their data is being processed — including whether it is being analysed by AI tools. Your privacy notice must be updated to reflect AI use.
AI providers are data processors. Before transferring personal data to them, you must sign a Data Processing Agreement that includes the required GDPR clauses — governing security, sub-processors, data breach notification, and deletion.
If using AI involves large-scale processing, systematic monitoring, or special category data, a DPIA is mandatory before you begin. This applies to HR tools using AI, patient data analysis, and customer profiling.
US-based AI servers mean personal data crosses EU borders. This requires either Standard Contractual Clauses (SCCs), a Transfer Impact Assessment (TIA), or reliance on an adequacy decision. None of this is required if the data sent to the AI contains no personal data.

Specific Risks by Data Type
CVs, payslips, and performance reviews contain names, addresses, DOBs, salary figures, and national IDs. HR data processing with AI requires a lawful basis and often a DPIA.
Article 9 special category. Highest-risk document type. Explicit consent or specific legal basis required. HIPAA also applies for US healthcare. Never share with AI without full de-identification.
Contain client names, IDs, signatures, and financial terms. Using AI for contract review without redaction transfers personal data of signatories — who have not consented to AI processing.
Accumulate sender/recipient names, email addresses, phone numbers, and details about third parties who have not consented to AI processing. Often overlooked as a PII source.

Before Using Any AI Tool with Documents
